Drug and alcohol intoxication: mens rea defenses   (Site not responding. Last check: 2007-09-10)
If there is no mens rea such as in an accident, an individual cannot be found guilty of a crime requiring criminal intent.
Mens rea defenses are partial defenses that can negate a specific intent and thereby result in a defendant being found guilty of a lesser-included crime.
Mens rea defenses frequently are used in murder trials.

Mens rea basically means a guilty mind and refers to the state of mind of the accused at the time the actus reas (act of the crime) is committed.
Mens rea and actus reus must exist at the same time.
Cases that don't require mens rea are known as strict liability offences.

#3 Mens Rea, Justification and Affirmative Defenses
Mens rea is a Latin term coming from the phrase Actus non facit reum nisi mens sit rea, where the full phrase translates roughly to 'an act does not make a man guilty unless his mind be also guilty' and mens rea means 'guilty mind.' Mens rea is the difference between intent and accident.
In this way, a legally insane defendant could have mens rea, but no malice and insufficient appreciation that the criminal act was wrong or bad (of course, the issue is much more complex than this).
This means that the defendant committed the act (which is called actus rea, guilty act) and had the mens rea or intent of the act, but it was not wrong and not illegal because he had a good reason to do it.

Section VIII: Idaho, Montana And Utah
In addition to enacting the mens rea insanity defense in 1983, it is of interest that in 1986 the Utah legislature enacted an amendment which authorizes a diminished capacity concept (as well as the mens rea insanity defense).
It is of interest to consider the early history of the mens rea insanity defense (prior to the proposals by the Justice Department for the federal system, and prior to adoption of that defense in Idaho, Montana and Utah).
Thus this early history of the mens rea insanity defense indicates that at least some psychiatrists and psychologists welcomed it as a way of liberating their testimony from the restrictions of traditional insanity defenses (and thus increasing their involvement in criminal justice matters).

Voluntary intoxication is not a defense to a crime having a general mens rea requirement, such as criminal negligence.
If the evidence indicates that the drunkenness prevented the defendant from forming the specific mens rea necessary, then that element of the crime has not been established and, as a consequence, the crime itself has not been proved.
In effect, the defendant claims that drunkenness prevented formation of the necessary mens rea of the crime charged, but does not claim that his mental faculties have been destroyed.

CRIMINAL PENALTIES FOR CREATING A TOXIC ENVIRONMENT: MENS REA, ENVIRONMENTAL CRIMINAL LIABILITY STANDARDS, AND THE ...
Mens rea needs to be evaluated, however, with respect to any person whose behavior is implicated by neurotoxicity, including those responsible for discharges of neurotoxic materials into the environment.
Instead, her analysis suggests that although the application of common law mens rea standards to the prosecution of federal statutory environmental crimes may have made their enforcement confusing and inconsistent, it does not necessarily indicate fundamentally different ways of thinking about environmental and criminal law enforcement.
For other statutes, the crime is an ‘innocent activity offense’; mens rea therefore consists of the defendant’s awareness of the conduct, the factual circumstances, and either the law or a probable unlawful consequence.

For (a)(2)(A), the mens rea is intent to promote the carrying on of specified unlawful activity; for (a)(2)(B), the mens rea is knowing that the funds are proceeds of crime and knowing that the transaction was designed either to conceal the proceeds of specified unlawful activity or to avoid a reporting requirement.
For (a)(1)(B), which is covered in the next instruction, the mens rea is knowledge that the transaction is designed either to conceal the proceeds of specified unlawful activity or to avoid a reporting requirement.
First, it is based on a mens rea of intent to promote the carrying on of specified unlawful activity, as contrasted with the other part of (a)(2) which is based on a mens rea of knowledge.

 Section VI: Federal
I recommended that defendants also be allowed to focus on mens rea outside the insanity defense framework with an A.L.I. Section 4.02(1) concept to determine whether or not the defendant lacked the state of mind required as an element of the offense.
Thus, in an article published in 1977 he favored the mens rea insanity type of defense because of his belief that abolishing the traditional insanity defense and directly focusing on mens rea would liberalize the admissibility of mental disability evidence.
It is true that if the "actually formed" mens rea concept is interpreted to mean that, to be found not guilty of a certain degree of an offense, a defendant must fully or completely lack the mens rea for that degree, then that is a tight law and order concept.

Perhaps the intent is simply to set a high price (invocation of a defense that jurors may find unsympathetic, and/or probable indefinite post-trial incarceration in a psychiatric facility) for a criminal defendant's use of expert psychiatric testimony to excuse his wrongful acts.
