The Seattle Times: Nation & World: Memo shows Merck knew Vioxx's risk
NEW YORK — Merck researchers sought to reformulate Vioxx in 2000 to reduce its cardiovascular side effects, even as the drug maker was publicly playing down a study that highlighted the pain reliever's potential risk for heart attack and stroke, an internal company document shows.
Merck insisted at the time that this was a result of naproxen's cardioprotective properties and not any defect in Vioxx.
Merck attorneys said the patent application proves only that the company sought to help Vioxx users who had switched from aspirin, which is known to help prevent heart attacks by acting as a blood thinner.

The Murky History of Merck's Vioxx
Merck's (MRK :NYSE - commentary - research) decision to withdraw its popular arthritis drug Vioxx from the market in late September has raised questions about the process leading up to its regulatory approval in 1999 as well as the importance of subsequent medical studies.
Merck says rates of cardiovascular risk were "similar" among patients taking Vioxx, placebo or other pain relievers.
Merck later speculates that the difference is caused by the heart-protective effect of naproxen rather than the heart-risk effect of Vioxx.

Ambro ruled that Merck "should have disclosed [Medco's] revenue-recognition policy as soon as it was adopted," reported the Intelligencer, and he stressed that Merck was "treading a fine line" by failing to disclose the details of the accounting problems.

Merck, already facing more than 3,800 lawsuits filed for patients allegedly killed or injured by its Vioxx painkiller, was hit with a new legal attack Thursday as the state of Texas accused the firm of covering up the drug's health risks.
The first-of-its-kind Vioxx case, filed by Texas Attorney General Greg Abbott, seeks at least $168 million in damages from Merck, which withdrew the painkiller from the market in September after a study showed it increases the risk of heart attacks and strokes.
"Merck acted responsibly — from researching Vioxx prior to approval in studies with almost 10,000 patients — to monitoring the medicine while it was on the market — to voluntarily withdrawing the medicine when it did," said a statement issued by Ted Mayer, the firm's national counsel for product liability litigation.
