If Merck’s own documents show that Merck chose to conceal serious cardiac risks, it’s hard to brand the plaintiffs’ case as merely “emotive and subjective” or to attribute their victory to junk science, conflicting expert testimony, or quirks of this particular jury, or some general proclivity to kill off productive industries.
I had the impression from news accounts that Merck’s defense turned on the lack of evidence of causation — that even if Merck was a corporate sinner, Merck’s argument was that its sin had no effect on the deceased, and therefore the widow was not entitled to get money from them.
The verdict against Merck was surprising and, given the deeply conservative voting patterns of the electorate in Brazoria County from which the jury panel was chosen, it cannot be very comforting to Merck or to those Republicans aligned with business interests (such as Kyle Janek).
