Lower Merion will conduct a deer "cull" in violation of the protections guaranteed by the statutes of the Commonwealth, that were promulgated for the public good, and will thereby permit the discharge of firearms at any time of the day or night for nine months of the year within designated residential areas.
Moreover, as many other residents of Lower Merion face the same irreparable harm as that threatened against plaintiffs, and as the safety statutes violated by the deer control permit were enacted for the wellbeing of all the residents, the balance of possible harms weighs heavily in favor of issuing a preliminary injunction in this case.
