Metro-North Railroad - Wikipedia, the free encyclopedia
The Metro-North Railroad (officially the Metro-North Commuter Railroad Company, and usually abbreviated as Metro-North) is a suburban commuter railroad service between New York City to its northern suburbs in New York State and Connecticut.
The third rails on all three of the eastern Metro North lines are unusual in that power is collected from below the third rail, as opposed to above, which is the case in the vast majority of third rail systems.
Metro-North is operated by the Metropolitan Transportation Authority, which also operates the MTA New York City Transit buses, the New York City Subway and the Long Island Rail Road.

 Park Avenue (Metro-North) Railroad Bridge
Today, the lift span is operated by the MTA Metro-North passenger railroad.
While the swing span was being constructed from 1891 to 1893, the railroad constructed a temporary wooden and deck-truss drawbridge north of the existing span, and dismantled the old iron bridge.
The railroad and the City of New York split the construction expenses for the new railroad bridge.

 Metro North Commuter Railroad Co. v. Buckley, 521 U.S. 424 (1997)
Metro North stipulated in the District Court that it had "negligently exposed the plaintiff Michael Buckley to asbestos while he was working in Grand Central Terminal from June 1985 to the beginning of September 1987." App.
Metro North did not tell the pipefitters of, or provide protection against, the danger to which the workers were exposed until 1987, two years after Buckley started working in the steam tunnels.
Thus, Metro North, "through [its] negligence, caused the plaintiff, in the opinion of medical experts, to need specific medical services--a cost that is neither inconsequential nor of a kind the community generally accepts as part of the wear and tear of daily life.

More recently, the Court applied the "physical impact" prong of the zone of danger test to a case in which the plaintiff was negligently exposed to large quantities of asbestos while working as a pipe-fitter for Metro- North.
Railroad employees thus will be able to recover for injuries - physical and emotional - caused by the negligent conduct of their employers that threatens them imminently with physical impact.
