Section XVI of Article 123 of the Mexican Constitution states that "both employers and workers shall have the right to organize for the defence of their respective interests, by forming unions, professional associations, etc." Furthermore, the introductory clause of Article 123 has been construed to protect the right to bargain collectively.
Mexican labour law protects against interference in the exercise of freedom of association by prohibiting dismissals except for just cause, by regulating collective layoffs and terminations so that they take place in order of reverse seniority, and by directly prohibiting many forms of interference.
Thus, a discharged Mexican worker does not have to show that antiunion motivation was a factor in the dismissal; the burden always rests with the employer to prove that the reason for the discharge falls within the statutory definition of just cause for discharge.
