The Michigan Department of Corrections (MDOC) has been repeatedly criticized for failing to stop abuses in its prisons and recently settled a federal case concerning sexual abuse of women prisoners.
In the face of several other lawsuits, the Michigan Department of Corrections successfully lobbied the Michigan Legislature to declare that all people incarcerated in the state, including juveniles and pre-trial detainees, cannot seek legal redress for violations of their human rights.
Michigan's strategy of denying abuses and stifling criticism is consistent with past practices in which MDOC denied federal investigators access to its women's prison and attacked the credibility of those documenting abuses in prisons.

In 1978 Michigan enacted the harshest mandatory sentences in the nation, including the notorious "650 Lifer Law." This law mandated life in prison without parole for offenders convicted of delivery of over 650 grams of heroin or cocaine.
In 1987 the Michigan legislature adopted another type of mandatory sentencing law (consecutive sentences.) Sentences for drug offenses, unlike most other serious crimes, must be served consecutively to any term of imprisonment for another felony.

Certainly, the grassroots term limits movement that swept Michigan and the rest of the country in the early 1990s wasn’t aimed at maintaining feeding tubes in the terminally ill. Backers of the Michigan proposal almost never cited specific legislation in their campaign to change the state’s constitution.
Michigan taxpayers who were railing against the onerous burden of supporting a school system that didn’t seem to work weren’t asking whether their Legislature had enough experience to do something about it; they wanted action.
If Michigan’s unemployment in 1999 is at 8.9 percent instead of its current 3.9 percent, land use is not going to top the state agenda no matter what the level of experience of those who set it.

 Michigan legislature repeals mandatory sentencing laws
On December 12, 2002 a bipartisan majority in the Michigan Senate voted in favor of three reform bills - HB 5394, HB 5395, and HB 6510 - that "eliminate most of the state's Draconian mandatory minimum sentences for drug offenses," according to a news release from Families Against Mandatory Minimums (FAMM).
"Michigan's prosecutors recognize that an effective drug policy is a combination of criminal justice strategies, readily available drug treatment programs, incarceration where appropriate, and prevention activities in schools, businesses and homes," said a supportive David Morse, president of the Prosecuting Attorneys Association of Michigan.
Former Michigan Governor William G. Milliken campaigned for the repeal of mandatory minimum laws, calling his 1978 signing of their enabling legislation the "worst mistake of my career" in office.
