Microcell noted that in Regulation of Mobile Wireless Telecommunications Services, Telecom Decision CRTC 96-14, 23 December 1996 (Decision 96-14), the Commission had determined that the degree of competition in the market for public switched mobile voice services was sufficient for it to forbear from the exercise of many of its regulatory powers in this market.
Microcell argued, however, that it was necessary to consider the ILECs as one group in the wireless market due to an extended and enhanced roaming arrangement (the roaming agreement) entered into in October 2001 and still in existence at this time.
Microcell submitted that both the RWI Offer and the Bell Mobility Offer were unjustly discriminatory and that pursuant to section 27(4) of the Act, the onus was on each of RWI and Bell Mobility to demonstrate that the discriminatory activities and preferential treatment were neither unjust nor undue.
