A "migrant farmworker" is defined by the State Sanitary Code as "an individual who is employed in farm activities of a seasonal or temporary nature" (10 NYCRR §15.1(e)).
A State Department of Health permit for "migrant farmworker housing" does not apply to a "property which is primarily occupied or maintained for persons other than migrant farmworkers" (10 NYCRR §15.2(b)(1)).
The proof should also indicate the number of migrant farmworkers who reside therein, the seasonal or temporary farm activities for which they are employed, and the amount of their rental payments.

The objective of this program is to reduce the risk of communicable disease transmission and injury among migrant farm workers by establishing comprehensive and uniform procedures for permitting and inspecting migrant housing.
If the department finds after inspection that the proposed migrant labor camp or residential migrant housing operation conforms to the minimum standards required by the rules, and the applicant has paid the fee when required, the department shall issue a permit for operation for the migrant labor camp or residential migrant housing.
Migrant labor camps and residential migrant housing shall be inspected AT LEAST twice quarterly during periods of occupancy except housing authorities which shall only be inspected twice annually.

"Migrant Labor Camp" means one or more buildings, structures, tents, trailers or vehicles or any combination thereof together with the land appertaining thereto established, operated or maintained as living quarters for ten or more migrant workers or 4 or more families containing migrant workers who are engaged in agricultural activities.
Plans for the construction of a Migrant Labor Camp or for any major alteration or major expansion in any such camp or the facilities thereof shall be submitted to the Department for approval prior to the construction or the making of such major alteration or major expansion.
The Department may make and adopt such reasonable rules and regulations relating to Migrant Labor Camps as may be necessary to carry out and administer the provisions of this Act and to assure the safety of the migrant workers and their families.
