 Mudd Appeal Denied
Thomas A. White, Secretary of the Army, et al., Appellees Appeal from the United States District Court for the District of Columbia (No. 97cv02946) Philip A. Gagner argued the cause and filed the briefs for appellant.
Appellant's interest in correcting the military record that relates to his great-grandfather's conviction is not within the "zone of inter- ests" protected by the statute covering the correction of military records.
The District Court also found that the Secretary's application of the "law of war" principle instead of the martial law principle found in Milligan was not arbitrary, capricious, or contrary to law.

First, the Secretary of Defense should, as soon as possible, announce Department of Defense policies for disposal of property at bases that are closed or realigned during the coming BRAC round.
As DOD implements basing changes and communities adapt to the loss or gain of military forces, I expect to continue to conduct oversight of the process to ensure that military readiness is not diminished and that every community affected by BRAC receives the guidance and support it needs to successfully recover.

Jones and all of the witnesses said the change in title would not affect the Navy secretary's authority or any of the legal functions of his department, but would give the Marines equal status.
