Miller charges that all defendants engaged in a concerted effort to terminate the operation of Miller's business in violation of section 1 of the Sherman Antitrust Act, 15 U.S.C. s 1 (count I), and sections 1, 2, and 6 of the Civil Rights Act of 1871, 42 U.S.C. ss 1983, 1985(3) and 1986 (count II).
Both Miller and the Township appealed the order of the Hearing Board and that appeal is presently pending before the Court of Common Pleas of Bucks County, Pennsylvania.
Although the complaint only states in broad, conclusory language that Miller had been deprived "rights, privileges and immunities under law", the gravamen of the s 1983 claim is apparently that plaintiff has a property interest in its quarry operation and that the defendants have deprived Miller of the full use of that property.

Miller Township was the eighteenth township to be created in Perry County, erected by the State Legislature on March 11, 1852.
Four distinct parallel ridges traverse Miller Township from east-northeast to west-southwest and determine the main features of its physical geography- Buffalo Hills, Limestone Ridge, Mahanoy Ridge, and Dick's Hill.
The basin of this stream is bounded by Mahanoy Ridge and Limestone Ridge, and ends at Baileysburg (Hain, H. History of Perry County, 1922).

 the Jersey Settlement
"In the central portion of Forward township is a locality known for a hundred years or thereabouts as the "Jersey Settlement." This is the oldest settlement within the limits of the township, and dates from the year 1766.
Crumrine (History of Washington County) reports that a group of families from Morris Co, New Jersey, followed and settled in Amwell Twp, Washington Co in 1778.
Descendant Jarrett Wall was said to be among those "resisting the unjust demands of the proprietary in 1700-01." Walter Wall who migrated with the Jersey settlement was a son of Humphrey Wall, and a grandson of this Jarret Wall.
