		Ly, a citizen of Vietnam, challenged the constitutionality of § 236(c) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA), which requires the Attorney General to detain immigrants who have committed certain crimes, pending removal proceedings.
		The INS asserted that Ly was subject to removal(1) from the United States because he was an alien convicted of two crimes involving moral turpitude, and he was an alien convicted of an aggravated felony.
		Ly asserts that he would have been eligible for cancellation of removal under the former 212(c) waiver because prior to 1996, Ly’s conviction was not considered an “aggravated felony” under the Immigration and Naturalization Act (“INA”).

	Hoang Minh Ly v. Mark B. Hansen, James Ziglar, and John Ashcroft
		Ly alleges that the section violates substantive and procedural due process under the Fifth Amendment because it does not allow criminal aliens individual bond hearings to determine their suitability for release pending removal proceedings.

	Another Senseless Hate Crime by Mai Pham
		Tragedy befell the Vietnamese community on Jan 29, 1996, when Thien Minh Ly, a 24-year old Vietnamese man and former graduate of UCLA, was murdered while rollerblading in his Tustin hometown high school tennis court.
		It was not until March 2, 1996 that the mystery surrounding Ly's murder ended.
		A candlelight vigil was held April 6, 1996 by the Council of Asian Pacific Americans of Orange County to raise awareness about violence against Asian-Americans; one of the people being honored was Thien Minh Ly.
