The Civil Service nationality rules are statutorily based and made by the Minister for the Civil Service under the power conferred on him by the Civil Service Order in Council.
The rules give effect to statutory provisions on the employment of aliens in the Civil Service which are contained in the Act of Settlement 1700 and the Aliens Restriction (Amendment) Act 1919.

It has now been revealed that the advice that Mr Kerr was receiving from his civil service advisers was seeking to damp down the matter and even went to the extent of referring to Mr MacLennan's political views as if that were a relevant factor in his conduct or treatment.
