In June of 1977, Minnesota Mining, pursuant to the provisions of 12 O.S., served upon the plaintiffs, and each of them, Interrogatories and certain Requests For Admissions - the answers to the Requests For Admissions were due on July 31, 1977.
No answers to the admissions were ever filed by the plaintiffs, and on August 29, 1977, Minnesota Mining filed a Motion for Summary Judgment, based upon the admissions which came about by virtue of 12 O.S., and the plaintiffs' failure to answer the admissions within twenty days.
The continued exercise of this power is clearly injurious to the petitioner, Minnesota Mining, and there is no legal remedy as adequate as the issuance of a writ of prohibition.

We understand the district court’s interpretation [of the term ”uniform flexible film”] to mean that the film must have the same thickness throughout, except that normal manufacturing tolerances are allowed.
  Specifically, the district court found that the textured Bando and Achilles films did not have the same thickness throughout because the films were “intentionally manufactured in a manner that results in an uneven thickness throughout the film.”  The district court, relying on this court’s decision in Festo Corp.
This court also takes this opportunity to comment on Middleton’s argument that a flexible film is “uniform” when its thickness falls within manufacturing tolerances.

The Kahn Gauthier Law Group is investigating possible legal actions against Baxter International Inc. and Minnesota Mining and Manufacturing Co. (3M) on behalf of kidney dialysis patients who were injured or killed by contaminated dialysis filters, called dialyzers, made by Baxter.
The fluid should have been removed from the filters at the end of the manufacturing process, but somehow it was not.
According to Baxter, the processing fluid was used in the manufacture of less than 10 percent of the A and AF series dialyzers.

They claimed that their respirator masks, which were manufactured by 3M, were ineffective in blocking asbestos fibers (Star Tribune, October 30, 2001; Dow Jones stories, January 31, 2002).
The men’s attorneys argued that the respiration masks were improperly labeled and that 3M knew that the masks did not prevent inhalation of asbestos particles.
