Kentucky has 58 coal-waste impoundments and MSHA has seven applications for impoundments pending in Eastern Kentucky, said officials with the agency's field offices in Pikeville and Barbourville.
In the filings, Massey noted a "subpoena for our documents relating to the impoundment and impoundment discharge that we have received from a federal grand jury of the United States District Court for the Eastern District of Kentucky.
