As well as prohibiting the use of the drugs concerned outside these lawful fields, the conventions and the MDA (mainly through the regulations made under section 7) are concerned to ensure that their use within these areas continues to be possible.
Drugs were placed in three Classes, listed in Schedule 2 to the Act, and penalties for offences were related to the Class of drug involved in the offence.
Confusingly the drugs are sometimes described as being Schedule 1, 2, 3, 4 or 5 drugs: such references are not to the Classes in Schedule 2 to the Act but to the Schedules to the related Misuse of Drugs Regulations 1985 [12].

Drugs liable to abuse which are not defined as narcotics under the Narcotics Act 1965 are controlled at present in New Zealand under the Poisons Act 1960, the Poisons Regulations 1964, and amendments.
Subclause (5) of clause 6 establishes a presumption that possession of certain quantities of drugs is possession for the purposes of supply, and therefore within the major offences of the clause unless the defendant shows that he possessed the drugs for his own use.
Drugs are reasonably well categorised in their rightful schedules, and as our knowledge and experience of the use of misuse of drugs increases we will have to capacity to change the drugs from one schedule to another.

The law places drugs into three different categories, known as Class A, B and C. Drugs regulated in this way are known as 'controlled' substances, and Class A drugs are those considered to be the most harmful, while drugs classified C are those considered not as harmful.

The principal Act currently provides for a rebuttal presumption that when a person is found with a certain amount of a controlled drug, he or she possesses that drug for the purpose of dealing or supplying it.
The onus is on the person found with the drug to prove that she or he was not supplying the drug and that the drug was intended for personal use.
The Bill will amend the principal Act to move the defence to the offence of possessing a needle or syringe from the regulations into the principal Act, and to reverse the onus of proof to the prosecution to prove that the needle and syringe was not obtained through the exchange programme.

Except as authorised by this Act or the regulations made thereunder, it shall be an offence for a person to have in his possession any pipe, syringe, utensil, apparatus or other article intended for the smoking, administration or consumption of a controlled drug.
If any controlled drug is found in any vehicle it shall, until the contrary is proved, be presumed to be in the possession of the owner of the vehicle and of the person in charge of the vehicle for the time being.
If any controlled drug is found in the urine of a person as a result of both urine tests conducted under section 31, he shall be presumed, until the contrary is proved, to have consumed that controlled drug in contravention of section 8 (b).

He said that it was anomalous that alcohol and tobacco did not have a Misuse of Drugs classification, given their toxicity, but that it would be untenable to expect them to go into existing schedules - meanwhile cannabis was under review and it was untenable for it to remain where it was.
She said that there was a current problem in that there was statutory provision for a Drug’s Advisory Committee, under the Misuse of Drugs Act 1975 (section 5), but that there had been an absense of such a committee, for some 5 years or so.

In this subsection "the substantive offence" means the offence under this Act to which the attempt or, as the case may be, the incitement or attempted incitement mentioned in section 19 was directed.
The Extradition Act 1870 shall have effect as if conspiring to commit any offence against any enactment for the time being in force relating to dangerous drugs were included in the list of crimes in Schedule 1 to that Act.
In the definition of "drug addict contained in section 16(1) of the Matrimonial Proceedings (Magistrates' Courts) Act 1960, for the words from "any drug” to "applies” there shall be substituted the words “any controlled drug within the meaning of the Misuse of Drugs Act 1971".
