Therefore, to the extent that the Department of Morobe Province purports to (1) take over Provincial Government Functions; (2) give functions and responsibilities to assigned public servants; and (3) bring those officers under Public Service Commission direction and control it is inconsistent with the Organic Law; see ss 24, 27, 43, 47(2), 50(4) and 57.
I note in passing that even if the Secretary, Department of Morobe could validly exercise powers in relation to assigned public servants, he could not be appointed to that position under the Constitution, s.

Morobe Provincial Government v Electoral Commission and Bafenu [1990] PGNC 27; N855 (20 April 1990)
The petitioner was a candidate for the Nabak Constituency in the Morobe Province and he alleged that 100 potential voters were turned away by the presiding officer and denied their right to vote.
Whilst I may have sympathy with the petitioner’s predicament, I find there is no (1) legal basis for the challenge because of s 95A of the Morobe Provincial Elections Act and (2) no evidence as provided in s 196 to permit this court to over-turn the election of the second respondent.
Part of the reason for such a regulation could be summed up in an answer given by the petitioner himself in cross-examination when asked how did he know that these 100 people would vote for him, he said “how do any of us know what is inside someone else’s head”.
