In Delaware’s case, DNREC determined that parts of the Murderkill River in Kent County were “quality limited” because of either high levels of nutrients or low levels of dissolved oxygen in the water.
Kent County operates the single largest water treatment plant in the Murderkill River watershed, and is the only point source discharge on the lower part of the Murderkill River.
Golt says while the county supports the reduction of pollutants in the river, she doesn’t agree with the proposed levels for the tidal portion of the river.

Whoever willfully destroys or removes any of the stakes settled and planted to designate the channel of Murderkill River, by and under the authority of Chapter 153, Volume 13, Laws of Delaware, shall be fined $20 for each stake removed.

To date over 2,028 acres and 3 miles of river corridor have been protected at Killens Pond State Park and the Murderkill River Nature Preserve, stretching from Route 13 to Frederica.

They have filed suit challenging the Administration’s approval of a flawed clean-up plan (technically termed a “total maximum daily load”) for that river.
