Under Section 36.401(d)ii of the ADA regulations, if the theatre is in a shopping center and the mezzanine is not part of a floor level housing at least one retail establishment, the mezzanine is not considered part of the shopping center and does not have to be accessible by elevator.

LAS VEGAS -- National Association of Theatre Owners president John Fithian has endorsed controversy, drawing appreciative laughter from exhibitors and distributors during his opening-day remarks at the ShoWest conference held at the Paris hotel on Tuesday.
The NATO president did issue one word of caution to theater owners who have begun building new screens nationwide.
He added that a similar thing happened when Republicans protested "Fahrenheit" by urging theater owners not to book the film, which provoked the left to respond in support of the film, while Moore "laughed all the way to the bank," proving that the "movie theater is the bastion of the First Amendment."
