It would be that the general rule for law enforcement and national security would be that someone who has these records in one of the three categories, may only disclose protected health information pursuant to a warrant.
The proposal does not currently allow individuals to opt-out of having their individually identifiable health information used in research and I would propose that there would be an opt-out provision allowing individuals to choose not to have their records used in research.
Once you have established a procedure for doing that, whether you are doing audit trails for public health, or research, or law enforcement, or something else, you are going to have the facility to do it, or you ought to be able to do so.
