These national parks were designated as such under the National Parks (Scotland) Act 2000, legislation passed by the devolved government in Scotland, almost 60 years after the idea of British national parks was first suggested.
When the National Parks and Access to the Countryside Act 1949 was passed to enable the creation of English and Welsh national parks, two objectives were enshrined into the legislation.
Like the national parks of England and Wales, neither of the Scottish parks are wilderness areas owned by the government.

 National Parks (Scotland) Act 2000
Subsection (3) requires a National Park authority to send a report on its year's activities to the Scottish Ministers as soon as practicable after the end of the year, the Scottish Ministers being required to lay a copy of the report before the Scottish Parliament and publish it (subsection (5)).
Under subsection (4) two National Park authorities may arrange to carry out functions jointly, and under subsection (5) these arrangements may include establishing a joint committee or for an officer carrying out the functions.
National Park authorities are required by this section to put in place an advisory group or groups to advise it on its functions.

Scotland is one of the last countries in the world to establish a national parks system and the Ramblers' Association has welcomed the new Bill which will lead to Loch Lomond and the Trossachs and then the Cairngorms achieving national parks status within the next two years.
Ramblers Scotland Director Dave Morris said: "The establishment of the Scottish Parliament has provided the driving force for land reform and we are delighted that national parks are at the forefront of this work and are arriving on the statute book within the Parliament's first year.

A National Park authority is required to appoint a monitoring officer whose duty is to report to the authority and its members on anything in the operation of the authority which contravenes the law or amounts to maladministration.
A National Park authority may also be required to make transfer schemes for transfers from the National Park authority to another National Park authority or a local authority where a National Park is wound up or modified or in connection with the operation of the National Park authority.
Sub-paragraphs (3) and (4) have the effect that new country and regional parks may not be created within areas after their designation as National Parks, although the provisions relating to existing country and regional parks will continue in force.

Responsibility for National Parks in Scotland lies with the Scottish Parliament and Executive.
Loch Lomond and the Trossachs was confirmed as Scotland's first National Park on 19 July 2002 and the Cairngorms was opened on 1 September 2003.

National Parks are for protecting and enhancing the natural and cultural heritage; helping people to enjoy it and use it without damaging it; and perhaps most importantly, assisting local people with social and economic issues.
This last point is important if Parks are to gain the level of support and commitment from local communities they will need to be successful.
These purposes should be pursued in ways which are mutually supportive, and resolution in the event of any conflict between them should be guided by a precautionary approach in favour of the long-term conservation of natural resources.

The Bill to provide for National Parks was generally welcomed but there were a number of areas of key concerns where participants considered that the Bill was not explicit enough or where the provisions were not considered adequate.
Although the Bill allows scope for the introduction of marine national parks, it was thought that "land and sea" should be specified in the Bill.
It was thought that one measure of the success of National Parks should be the degree of participation from interested parties that was secured in managing the park.

The idea of a marine national park to protect Scotland's dolphins, whales, basking sharks and sea birds was first mooted in February 2000.

The Scottish Council for National Parks was formed originally in 1943 and operated until 1967, when it was stood down as a result of the setting up of the Countryside Commission for Scotland (CCS).
It was reconstituted in 1990 following the publication of the CCS's report on the 'Mountain Areas of Scotland' for Government, which recommended the creation of National Parks in Scotland.
The establishment of a National Park in the Cairngorms presents an opportunity to focus on this, and other difficult issues, and develop innovative solutions which can then be applied across the country.

MOVES to protect Scotland’s coastal areas, including the possibility of marine national parks and a national coastline park, were outlined by the Scottish Executive yesterday.
