NE Tel & Tel v. City of Franklin
Telephone poles often have a life expectancy or replacement cycle exceeding forty years, and must be sufficiently sturdy to withstand harsh weather and vehicle collisions.
In addition, the very nature of telephone poles and wires, as well as their use by the plaintiffs in connection with integrated telecommunications systems, belies the proposition that the equipment became a permanent and essential part of the underlying realty so as to pass by conveyance with it.
Furthermore, the statute governing the licensing of telephone poles and wires on public ways specifically provides for their removal on ten days' notice and therefore establishes, as a matter of law, their impermanence.

 Docket No. 9627
In its post-hearing brief, New England contends that the installation of telephones is not construction work even when the installer is working in a building under construction and that, for that reason, it cannot be charged with violations of the Construction Standards.
Whether New England's installer was a laborer or mechanic is determined by what he did, not by what label he was known.
Having found that New England is an employer subject to the provisions of the Construction Standards, I now come to consideration of the merits of the citations.

Second, the court observed that, although the Commission required refunds for excessive rates of return but had not provided for carriers to be compensated for shortfalls in the rate of return, that asymmetry was not improper: carriers "are entitled only to earn an overall reasonable return," and they have an ample opportunity to do so.
Thus, the court noted that carriers may at any time file new rates that are designed to achieve an adequate return; if a shortfall appears likely, carriers can propose an appropriate rate change.
If the Commission promulgates a new rule, a challenge to such a rule would provide a more suitable case for review of the refund question, as it would involve a more complete record on pertinent issues (such as the proper relation between rate of return excesses and shortfalls).

The trial court did not err in granting Bell Atlantic's motion for judgment as a matter of law, nor in denying plaintiff's motion for a new trial on the same issue, and accordingly dismissing Bell Atlantic as a party to the case.
Finally, plaintiff appeals the trial court's denial of his motion for a new trial based on his claim that the court erred in refusing to admit medical records concerning treatment from medical providers who would not be testifying at the trial.
