Cautioned by New York to cease and desist, Wentworth promised to await the judgment of the king, and refrain from making more grants in the claimed territory until it was rendered, but in November 1753, New York reported that he had continued to grant land in the disputed area.
Grants briefly ceased in 1754, because of the French and Indian War, but in 1755 and 1757, Wentworth had a survey made 60 miles (97 km) up the Connecticut River, and 108 grants were made, extending to the line 20 miles east of the Hudson, and north to the eastern shore of Lake Champlain.
New York went to the British authorities, requesting a confirmation of their original grant, and the crown resolved the border dispute between New York and New Hampshire in favor of New York.

New Hampshire Grants, early name (1749–77) for Vermont, given because most of the early settlers came in under land grants from Benning Wentworth, the colonial governor of New Hampshire.
Although the 1664 charter for New York set New York's eastern boundary at the Connecticut River, it was modified by Connecticut in 1683, and Massachusetts in 1749 (officially 1757), at a line 20 mi (32 km) E of the Hudson River (c.45 mi/70 km W of the Connecticut River).
New York protested the infringement, but the French and Indian Wars intervened, and it was not until after 1760 (when Wentworth had resumed making grants) that the matter was brought before British authorities.

The territory that afterward became New Hampshire was included in a grant of land in 1622 by the Council for New England to Sir Ferdinando Gorges and John Mason, both of whom had been interested in New England affairs from the beginning.
These were called the "New Hampshire Grants." But in 1765 the king decided the contest in favor of New York, and when the governor of that colony ordered the settlers, now several thousand in number, to repurchase their lands, they rose in rebellion.
A second patent to New Hampshire was granted to Mason November 7, 1629, and the name New Hampshire was used; ten days later another to Gorges and Mason for "Laconia," and two years later still another to the same for the land near the mouth of the Piscataqua.

After the New York Supreme Court ruled that any claim to ownership of land granted by New Hampshire was invalid, Ethan became extremely involved in defending these Yankee grants.
He did so to protect his own considerable interests and those of the pioneers who came north from Connecticut and Massachusetts after the end of the French and Indian War in 1759.

Wentworth's "New Hampshire Grants" set the stage for a bitter struggle between "Yorkers" and settlers who, having bought land from the speculators, had endured the hardships of making a life in a wilderness.
While King George II had placed the eastern boundary of New York 20 miles east of and parallel to the Hudson River (roughly its present location), his grandson, George III, decreed the Connecticut River to be the boundary, invalidating settlers' claims to the land.
He had accumulated a sizable fortune from The Grants, and the hornet's nest he had stirred up in creating what would become Vermont was now in the hands of his nephew John, who succeeded him as Governor.
