Significant legislation cannot be passed without the agreement of the Governor, the Speaker of the New York State Assembly, the Majority Leader of the New York State Senate, the majority of the Democrats in the State Assembly, and the majority of the Republicans in the State Senate.
Moreover, the legislature’s current contingency budget proposal, if enacted into the state constitution, could be used to contradict other constitutional requirements, including the requirement that the state balance its budget, and the requirement that it provide a sound basic education for all the children of the state.
One of the strangest aspects of New York’s political culture is that is considered a shocking violation of prevailing norms if the State Assembly, State Senate, or City Council pass a budget on their own, prior to cutting a deal with the Mayor or Governor.

 The Legislature's Spurious Budget Reform
The Executive Budget amendments to the constitution were approved by New York voters in 1927 with the strong support of a bipartisan reform coalition spearheaded by then-Governor Alfred E. Smith, a Democrat frustrated by his limited ability to control and shape spending under the previous system.
Indeed, it flatly prohibits the Legislature from acting on the governor's bills after a new fiscal year begins.[4] From any governor's standpoint, the "final action" clause in the proposed amendment is a real poison pill; if enacted, it would mean the Legislature could effectively kill any executive budget merely by doing nothing.
School aid for the new fiscal year would be both automatic and veto-proof, even if (as was the case in 2003) revenues are dropping and the governor needs to close a huge budget gap.

The New York Times reported on Dec. 15, 2005 ( "Few State Prisoners Freed Under Eased Drug Law") that "When Gov. George E. Pataki signed a law a year ago reducing what he called "unduly long sentences" for drug crimes, he predicted that hundreds of nonviolent drug offenders would be released from prison.
New York spends more than $500 million a year to incarcerate nonviolent drug offenders, many of whom can rebuild their lives faster if they receive treatment, said Michael Blain of the Drug Policy Alliance, an organization that espouses reducing both drug misuse and drug prohibition, and promoting the sovereignty of individuals.
New York Newsday reported on March 1, 2001 ( "The War On Drug Laws") that Brown "is the target of activists because he has become the point man for the state's 62 district attorneys in lobbying against reform of the tough laws."
