Ngati Apa was concerned that, if the MAC decision stood, it would prevent the Waitangi Tribunal from investigating their claims to some South Island lands.
Ngati Apa conceded that if they sought any recommendations from the Waitangi Tribunal inconsistent with the 1998 Settlement Act then legislative amendment would be required yet their attack on the decision of the MAC appeared to inconsistent with the 1998 Settlement Act.
Ngati Apa were now seeking both that the MAC decision be set aside and that the court declare that the Waitangi Tribunal could hear the Ngati Apa claim to these West Coast lands.

Ngati Apa leaders Te Hanea and Te Pouhu responded to Te Rangihaeata's gesture by presenting Te Pikinga with a slab of greenstone called Te Whakahiamoe, which was made into adzes.
Ngati Toa regarded the three women Te Pikinga, Takaoi and Tangutu as assurance of their occupation of the land; their own mana was a mana of conquest over the people.
Ngati Apa had been left in quiet possession of their lands in the vicinity of the Rangitikei River, but not all were reconciled to the loss of Kapiti and part of Manawatu.

Te Rangihaeata agreed that Ngati Apa should remain unmolested on their land and left Te Pikinga for a period at Rangitikei as 'he pou rohe', the embodiment of his authority, or mainstay, within the region.
Also about the year 1824, the Ngati Ira family of Tamairangi were captured by Ngati Mutunga at Ohariu; Tamairangi, believing she was about to be killed, sang a lament so haunting that Te Rangihaeata, who was visiting Ngati Mutunga, was moved to extend his protection to the family, taking them with him to Kapiti Island.
Ngati Rangatahi, originally from Wanganui, had assisted Ngati Toa in their years of struggle, and had been granted rights of occupation in the Hutt in return for gifts of tribute, birds and other produce.

The Ngati Kuri hapu of Rangitane were slaughtered in East Bay and their bodies com-mitted to the umu at a bay that became known as Umukuri Bay.

Ngati Toa were driven back to the pa of Te Totara, at the southern end of Kawhia Harbour, where peace was made, but it was broken when Te Rauparaha led a fishing party into grounds claimed by Ngati Maniapoto.
Ngati Toa had long-standing alliances with the tribes of northern Taranaki, the southern neighbours of Ngati Maniapoto.
Ngati Toa was defeated at Te Kakara, near Lake Taharoa, and Waikawau pa, south of Tirau Point, was captured.

In Ngati Apa the Court of Appeal rejected the Wi Parataview of the common law and held that the Ninety-mile Beach decision was wrong.
In Ngati Apa the Court of Appeal held that a native title might exist in the foreshore or the seabed if no Crown grant or statutory grant has ever been made of a title covering those areas.

As leader of Ngati Patu-tokotoko hapu of Te Ati Haunui-a-Paparangi, Te Peehi Turoa was a major leader of the Wanganui tribes during the period of European impact in the first half of the nineteenth century.
In the early 1820s Te Peehi Turoa besieged Ngati Raukawa leader Puke at Makakote pa. However, it is said that he lifted the siege when he realised the pitiful condition of the starving people in the pa. He opposed the migration in the 1820s of Ngati Toa and its allies, including Ngati Raukawa, to Horowhenua.
Later, in 1829, Te Rauparaha sought revenge for the killing of some migrating Ngati Raukawa at Wanganui, and for the death of a Ngati Raukawa leader at Makakote, by organising an attack, supported by Ngati Raukawa, on Putiki Wharanui, a major Wanganui pa near the river mouth.

The effect of legislation In some parts of the Ngati Apa judgments the analysis of the effect of legislation is not as full as perhaps it might be.
In Ngati Apa Tipping J (para 202) was tentatively of opinion that the issue, pursuant to s 132 of Te Ture Whenua Maori Act 1993, of a certificate of title for Maori customary foreshore or seabed land, would be forbidden by the provisions against alienation in s 9A of the Revesting Act.
This might seem to confirm Richard Scragg’s suggestion in [2003] NZLJ 417 that “Ngati Apa seems to have been decided on the basis of a change of values in social policy, rather than that of a correction of an error of law”.

This involves changing the existing statutory jurisdiction of the Maori Land Court and the High Court with respect to the foreshore and seabed after Ngati Apa and replacing these with a remodelled new process, to be conducted by the Maori Land Court, which recognises Maori customary rights.
Following the Court of Appeal’s judgment in Ngati Apa Maori groups not unnaturally commenced filing applications in the Maori Land Court seeking investigations of title into defined areas of foreshore and seabed.
The Crown’s application was based on two grounds, that the Crown intends to legislate and because the Court of Appeal decision in Ngati Apa has been appealed by some of the parties to it — not, ironically, the Crown as it happens — to the Privy Council.

The Ngati Tama, Ngati Mutunga, and Te Atiawa tribes of that district, being related to Ngati Toa, gave a free passage to the expedition.
They were seen by Ngati Maniapoto after they had crossed the river but Te Rauparaha had a large number of fires lit to convey the impression of a large force and they were able to move south again without further molestation, finally joining their tribe, which was living with Ngati Tama.
The Ngati Toa withdrew to Waikanae and, while there, they were attacked by Te Hakeke of Ngati Apa with a considerable force from his own tribe and from Rangitane and Muaupoko.

There were originally three Maraes in the area, a stronghold of the Ngati Apa people.
The renovated Meeting House, dining hall [built in the 1980's] and Maori Anglican church are used regularly for many Ngati Apa events and also hosts many visiting groups.
At its peak in the late 1880's Turakina and the surrounding area boasted 3 churches, St Andrews Presbyterian (the current church was built in 1865), St George's Anglican Church (opened on 15th April 1883) and St Joseph's Catholic church (opened on 20th Sept, 1868).

It's taken the "Foreshore and Seabed" issue - stemming from last year's Court of Appeal decision in the Ngati Apa case - to convince Dr Cullen that activist judges are a threat to democracy.
What Cullen hasn't remembered to mention (yet) is the fiction, espoused by Lord Cooke and perpetuated in our law schools, that judges might have the power to openly strike down legislation if they think it violates our unwritten constitution.
Cullen's driving fear is that the Court of Appeal's decision on Ngati Apa could end up costing Labour its seats on the treasury benches.

 Scoop: Memorandum To The Waitangi Tribunal On Foreshore
It is accepted, however, that more time is needed to consider the large volume of submissions received and to engage in further dialogue with Maori and other interested parties before finalising that part of the policy that is to be the subject of legislation in February or March 2004.
The basic problem, as the Crown sees it, is that there appears to be an assumption that Ngati Apa represents confirmation that tikanga is fully cognisable by New Zealand law in the coastal-marine zone, and that tikanga operates as the only valid set of rights and obligations in that zone.
The Crown, however, proposes to wait until the parties to the Ngati Apa proceedings have had the opportunity to consider the contents of this Memorandum and then discuss whether terms of a joint application to the Maori Appellate Court can be agreed.
