Sir Ninian Martin Stephen KG, AK, GCMG, GCVO, KBE (born 15 June 1923), Australian judge and 20th Governor-General of Australia, was born in Oxfordshire, England, and migrated to Australia as a child.
In 1970 Stephen was appointed a Justice of the High Court of Australia, and in the same year he was knighted.
Stephen was made a Knight Commander of the Order of the British Empire in 1970, and sworn of the Privy Council in 1979.

Ninian Stephen: He pleaded guilty and in the course of making his plea, and subsequently on a couple of occasions when he appeared before the court, for instance for sentence, he described the circumstances in which he committed the act, which he admitted he had committed.
Ninian Stephen: Not as much as you'd imagine, and that largely because the statute which was imposed upon us, having been drafted in New York and approved by the Security Council, was quite clearly a common law model of trial that it set forth.

Sir Ninian, a former Governor General and ex-chairman of the UN Expert Group on Cambodia, says he's surprised that the Phnom Penh court decided to apply the amnesty for Khmer Rouge defectors to the kidnapping and murder of David Wilson and his fellow backpackers.
NINIAN STEPHENS: I think the outcome sounds very much like a travesty of justice, but the granting of what was apparently the amnesty applicable to this sort of offence, I would doubt whether that was the intention.
NINIAN STEPHENS: Well, as I say, it all depends on what sort of provision there is for an Appeal Court and also, I suspect, it depends rather on what the attitude of government in Cambodia is to this particular decision.

Drawing on his recent experiences as a war crimes judge, former Governor-General Sir Ninian Stephen will give a lecture on the future of International War Crimes Trials at the ANU on Thursday 21st May.
For the past four years Sir Ninian has been a judge on the International Criminal Tribunal for the former Yugoslavia, as well as a member of the Appeals Courts for the former Yugoslavia and for Rwanda.
Please note Sir Ninian is not intending to make his speech available until after he has delivered it, but copies may be available the next day.

Sir Ninian Stephen was born in 1923 at Nettlebed in Oxfordshire to Scottish parents.
His father, Frederick, who had been a motorcycle courier in the Great War, died before Sir Ninian was a year old, leaving him to be raised by his mother Barbara and with the assistance of Miss Milne, to whom Mrs Stephen was a companion.
In 1989 Sir Ninian became the first Australian Ambassador for the Environment, and in his three-year term was particularly energetic in working for a ban of mining in Antarctica.

Sir Ninian Stephen will give a public lecture at the University of Melbourne next month on judging war crimes, based on his experience as a judge on the International Criminal Tribunal for the former Yugoslavia.
Former Governor General and High Court judge, Sir Ninian was a judge on the tribunal until December 1997.
Sir Ninian's lecture is at 6pm on Wednesday 4 March 1998 in the Second Floor Lecture Theatre, 234 Queensberry Street, Carlton.

Gentleman has said about Sir Ninian Stephen, which I am sure will be much appreciated, and I am also grateful for what he said about the Government team and about my predecessor.
During that time, I believe that the discussions had very many areas of constructive dialogue and very many areas of agreement, as well as areas of disagreement, but that, in terms of the depth of the divisions in our society, is progress.

Australia's most eminent international jurist, Sir Ninian Stephen, has warned that Australia will miss out on the chance to shape "a historically profound achievement" if it fails to back the creation of the International Criminal Court.
Speaking from London, Sir Ninian said he had spoken out with great reluctance because he feared Australia might "forfeit the opportunity to be involved in the critically important process of selecting a prosecutor for the court".
Attorney-General Daryl Williams last night said Sir Ninian's views should be given considerable weight, as he was one of two Australians to serve on the criminal tribunal for the former Yugoslavia.

Sir Ninian Stephen was a judge of the Supreme Court of Victoria 1970-1972, a justice of the High Court of Australia 1972-1982 and Governor General of Australia 1982-1989.
Sir Ninian reminds us that 'an independent judiciary is in itself no sufficient guarantee of liberty or of the rights of minorities' because the courts' responsibility is limited to interpreting and applying laws made by parliament.
He believes 'community consensus supporting the independence of the judiciary may be less easy to maintain in the face of either highly activist judicial law-making or of judges entrusted with the interpretation and application of entrenched guarantees of human rights'.
