Ninth Amendment to the United States Constitution - Wikipedia, the free encyclopedia
Amendment IX (the Ninth Amendment) of the United States Constitution, which is part of the Bill of Rights, states:
It has been considered that the 9th Amendment was put in place just as a notice to the Congress that they were still a body constrained by a set of enumerated powers.
The Ninth Amendment, it is argued, recognizes that such natural rights are retained by the people and cannot be abridged by the government.

Thus the judicial imperialism of the Ninth Circuit is forcing the hand of the judicial imperialism of the Supreme Court.
If, on the other hand, the Supreme Court upholds the Ninth Circuit, the battle over abortion would likely be transformed into near unconditional warfare against the arrogance of courts that short-circuit democratic deliberation by the imposition of their moral (or grossly immoral) dictates.
The hopeful alternative is that the reckless presumption of the Ninth Circuit will provoke a long overdue reconstitution of the judiciary as the servant of the law and not the master of a people who were once free and are determined, one must hope, to be so again.

Taking the Ninth Amendment Seriously: Review of Massey
The presence of Ninth Amendment analogues in state constitutions is reason to conclude that nineteenth-century legal actors continued to regard the federal Ninth Amendment as instantiating dual paths to a single end of preserving human liberty.”
In giving effect to the Ninth Amendment, then, the courts are to recognize that one source of the unenumerated rights protected by the Ninth Amendment is state constitutions.
Further, under the state-specific concept of positive Ninth Amendment rights, unlike under the uniform national concept, a state could eliminate a positive Ninth Amendment right by eliminating it from its own constitution (although the reason for this difference in treatment is unclear).

James Madison's initial draft of the Ninth Amendment expressly adopted the language suggested by the state conventions and he insisted the final draft expressed the same rule of construction desired by the states.
In an episode previously unnoticed by scholars, the altered language of the final draft of the Ninth Amendment prompted Virginia Governor Edmund Randolph to bring to a halt his state's efforts to ratify the Bill of Rights, due to his concern that the Ninth no longer reflected the demands of the state conventions.
While ratification remained pending in Virginia, Madison delivered a major speech in the House of Representatives explaining that the origins and meaning of the Ninth Amendment in fact were rooted in the proposals of the state conventions, and that the Ninth itself guarded against a latitude of interpretation to the injury of the states.
