In 1990, Norfolk Southern Railway sold portions of their lines in Ohio and Pennsylvania, including most of the original lines of the former WLE, the Akron, Canton and Youngstown Railroad and the Pittsburgh and West Virginia Railway to a new regional railroad, the Wheeling and Lake Erie Railway (reporting mark WE) that operates today.

 Norfolk Southern Railway Co. v. Sorrell, Timothy - Medill - On the Docket
Norfolk Southern appealed the $1.5 million award to the Missouri Court of Appeals, Eastern District, contending that the trial court should not have allowed testimony regarding insurance for Sorrell and his wife.
On Jan. 10, 2007, the Court sided with Norfolk Southern, concluding that the causation standard under FELA should be the same for both categories of negligence.
Though the Court sided with Norfolk Southern, it also criticized the railroad for trying to smuggle in a larger question for the Court to consider after the Court granted certiorari in the case.

Southern Railway is the product of nearly 150 predecessor lines that were combined, reorganized and recombined since the 1830s.
Southern Railway was created in 1894, largely from the financially-stressed Richmond and Danville system and the East Tennessee, Virginia and Georgia Railroad.
Southern also subsequently controlled the Queen and Crescent Route (Alabama Great Southern; New Orleans and Northeastern; Cincinnati, New Orleans and Texas Pacific; and for a time the Alabama and Vicksburg), and the Georgia Southern and Florida, which were operated separately.

Southern later acquired many more companies and within a decade was one of the most extensive railway systems in the nation.
Southern Railway suspended passenger service to Johnson City in 1970 and the brick depot originally constructed in 1912 was dismantled in 1972.

After Larry Thaxton was diagnosed with lung cancer, he brought this suit against Norfolk Southern Railway Company and its subsidiary, Alabama Great Southern Railway Company, alleging injury from second-hand smoke.
He sued the defendants under the Federal Employers' Liability Act ("FELA"), 45 USC 51 et seq., claiming that his cancer was caused by the environmental tobacco smoke generated by his co-workers when he stayed in sleeping trailers while working on the railroad's tracks and railyards.
The trial court denied the motion, and we granted the interlocutory application to determine whether the court's denial of the motion to add these parties was proper.
