The borough responds by denying that its preference uses a race- conscious classification; instead, the borough insists, the preference adopts a well- accepted and constitutionally permissible political classification based on membership in federally recognized tribes.
CONCLUSION We conclude that the borough's hiring preference violates the Alaska Constitution's guarantee of equal protection because the borough lacks a legitimate governmental interest to enact a hiring preference favoring one class of citizens at the expense of others and because the preference it enacted is not closely tailored to meet its goals.

It is significant that, on the North Slope, the Borough was incorporated concurrently with establishment of the Arctic Slope Regional Corporation.
Since the Borough is not responsible for petroleum development and has little influence over whether, when, and where such development occurs on Federal and State lands, it can afford to press both development-taxation and environmental protection demands to their limits, often in apparent contradiction and without consistency or balance.
Currently the Borough is represented in several intergovernmental advisory groups and due, in part, to Federal and State laws mandating local involvement, the Borough participates routinely in various Federal and State development and environmental permitting processes affecting North Slope lands and waters.

ESRI News - Fall 1999 ArcNews -- Alaska's North Slope Borough Brings GIS to Bear
The North Slope Borough (NSB), Alaska, was one of the first in the world to use GIS in a local government's decision making process.
The goal of the GIS was to provide the NSB with the tools and information to track and assess cumulative impacts to the marine and terrestrial subsistence resources and to support Arctic science research.
This daunting task (the North Slope NSB spans an area of approximately 89,000 square miles, all of it in the high Arctic) was made even more difficult by first establishing the GIS program in Anchorage, Alaska, and 10 years later moving the entire operation to Barrow, Alaska, approximately 250 miles north of the Arctic Circle.
