This proposed rule differs from the final rule also in that it tentatively responds to issues raised in petitions for reconsideration of the June 2002 final rule and proposes to require a TPMS malfunction indicator.
Responsibility for this rulemaking was delegated to NHTSA.
Proposed requirements for color, wording, bulb check, and illumination format for the low tire pressure function (all discussed elsewhere in this proposal), would be unaffected by the incorporation of the TPMS malfunction indicator within the same telltale.

The Commission issued a Notice of Proposed Rulemaking that addresses the impact of CALEA upon Part 36 and convened a joint board to address the issues that are identified in Section 229(e)(3) of the Communications Act.
The proposed action is also authorized by Sections 1, 4, 201, 202, 204, 205, 218, 229, 332, 403 and 503 of the Communications Act of 1934, as amended, 47 U.S.C. Sections 151, 154, 201-205, 218, 229, 301, 303, 312, 332, 403, 501 and 503.
The proposed rules require telecommunications carriers to establish policies and procedures governing the conduct of officers and employees who are engaged in surveillance activity.

The proposed amendment is intended to clarify the existing statutory requirement that lead agencies approving projects in accordance with certified regulatory programs shall file a notice of the decision on the proposed activity with the Secretary for Resources.
The proposed revision to this section would remove the thermal desorption provision from this section because this type of project is accompanied by air emissions that may affect area residents.
The proposed amendments are intended to update the language to reflect case law developments and to enhance the clarity of this section.

The rulemaking was commenced by publication in the Federal Register of an advance notice of proposed rulemaking (``ANPR'').
Therefore, since the proposed rule may increase the cost of manufacturing multi-purpose lighters by $0.40 and may increase the retail prices by as much as $0.80, the net benefit to society of the proposed rule is expected to be at least $0.53 per unit ($1.33 - $0.80).
Further, the proposed rule is not expected to affect the manner in which multi-purpose lighters are packaged for sale or the amount of butane or other fuel used in the operation of the lighters.

We propose to designate for support these additional telecommunications services to the extent "necessary for the provision of [rural] health care services in a State."[196] We ask interested parties to propose descriptions of the kinds of telecommunications services that are "necessary for the provision of [rural] health care services."[197]
Action as proposed for this rulemaking is contained in Sections 101 and 102 of the Telecommunications Act of 1996 (to be codified at 47 U.S.C. [[section]][[section]] 254 and 214(e), respectively).
Wherever possible, the Notice proposes general rules, or alternative rules to reduce the administrative burden and cost of compliance for small telecommunications service providers.

This extension applies to all telecommunications carriers proposing to install or deploy, or having installed or deployed, any equipment, facility or service prior to the effective date of Section 103, for that part of the carrier's business on which the new equipment, facility or service is used.
With this Further Notice of Proposed Rulemaking, we propose rules to implement CALEA pursuant to section 229 of the Communications Act of 1934, as amended, 47 U.S.C. section 229.
The proposed action is also authorized by sections 1, 4, 301, 303, and 332 of the Communications Act of 1934, as amended, and section 107(b) of CALEA, 47 U.S.C. sections 151, 154, 301, 303, 332, and 1006(b).

Based on the proposed rule, computer based narrated slide presentations must be both captioned and audio described if they are shown multiple times and to varied audiences, the composition of which may include people with hearing or vision impairments.
In that proposed rule, the Board requested comment on whether the final rule should cover all types of interactive transaction machines, such as point-of-sale machines and information kiosks, among others, rather than be limited to automatic teller machines and fare vending machines.
The remaining 30 percent is expected to require significant modifications to meet the requirements of the proposed rule, which is estimated to cost in the range of 1 percent to 5 percent based on discussion with industry experts.

 Advanced Notice of Proposed Rulemaking
In making this proposal, one of the most important issues that the Department must address is the effect that new or changed ADA Standards will have on the continuing obligation of public accommodations to remove architectural, transportation, and communication barriers in existing facilities to the extent that it is readily achievable to do so.
A proposed regulatory action that is deemed to be economically significant under section 3(f)(1) of that order (having an annual effect on the economy of $100 million or more) is required to include a formal benefit-cost analysis.
The Proposed Regulatory Framework, which is set forth in Appendix A, describes the approach that the Department is considering for the regulatory assessment that it must prepare in connection with the NPRM.

The Department of Justice has published an Advance Notice of Proposed Rulemaking (ANPRM) to begin the process of revising the Department's ADA regulations to adopt design standards that are consistent with the revised ADA Accessibility Guidelines published by the Architectural and Transportation Barriers Compliance Board (also known as the Access Board) on July 23, 2004.
Until the Department's rulemaking is complete, the revised ADA Guidelines are effective only as guidance to the Department (and to the Department of Transportation).
