NPfIT does not accept this as that assumes that, following the award of contracts to the LSPs, NPfIT staff were in a position to direct the LSPs about with whom they should negotiate.
NPfIT points out that this has not been an issue for over 200 sub-contractors in the programme, including other contracted GP system suppliers: "Which have been able to secure what they consider to be adequate insurance cover to protect their positions and comply with their contractual obligations."
NPfIT says that there is genuine scope for EMIS to sub-contract with LSPs.

The National Programme for IT (NPfIT) which is being delivered by the new Department of Health agency NHS Connecting for Health, is an initiative in the British National Health Service to connect England's 30,000 GPs to 300 hospitals, allowing access to all patient records by health professionals and patients.
In an interview in The Times newspaper of August 16, 2004 [2], the government's own Information Commissioner expressed concern over this and other national IT projects, indicating that there was a danger of the country "sleepwalking" into a surveillance society.
For instance, despite being called 'National' it has no links, planned or actual, to the equivalent system in Wales and there is no similar system yet proposed for Scotland; because Scotland and Wales are producing their own systems complying with the continuing trend of devolution of government reponsibilities.

The government's pet technology project, the multi-billion pound NHS National Programme for IT (NPfIT), is in danger of failing, lacks the leadership required to stop it drifting off course, and is in danger of morphing into "a camel", according to a senior figure in one of the main contractors implementing the project.
Rollerson described the process as a "gradual coming apart of what we are doing on the ground because we are desperate to get something in and make it work, versus what the programme really ought to be trying to achieve".
He says that despite its enormous size, the NPfIT is being managed as though it is a small IT project, because that is what people are used to.

Delays in fulfilling NPfIT contracts are now starting to trigger non-compliance penalties for some of the partners and this now presents an opportunity to re-negotiate contracts.

Earlier findings of limited consultation, however, have continued despite a continuing strong (84%) view that consultation is important: only 5% say they have had adequate consultation and 70% that they have had none — not much of an improvement on the previous survey’s findings of 4% and 75%.
Respondents cover a wide and well-balanced range of specialties and, in terms of grade, commitment and decade of qualification are a good representation of practising doctors on the GMC register, with a slight bias towards general practice.
That and the large sample achieved are strong indicators that respondents represent the views of the wider population of doctors affected by NPfIT.
