Nuclear installations are defined as reactors ( 3) other than those comprised in any means of transport (see paragraph 11), factories for the manufacture or processing of nuclear substances, factories for the separation of isotopes of nuclear fuel, factories for the reprocessing of irradiated nuclear fuel, and facilities for the storage of nuclear substances.
When nuclear incidents occur in the course of transport of nuclear substances, the choice of the person liable must fall either upon the carrier or upon the operator of the nuclear installation in connection with which the substances are carried.
Furthermore, the nuclear operator must compensate damage to the means of transport upon which the nuclear substances involved were at the time of a nuclear incident occurring in the course of carriage and outside a nuclear installation.

Injury or damage that, though not attributable to a breach of the duty imposed on an operator by this Act, is not reasonably separable from injury or damage that is attributable to a breach of that duty shall be deemed, for the purposes of this Act, to be attributable to that breach of duty.
An operator is not liable for injury or damage of the kind described in section 3 if the nuclear incident resulting in the injury or damage occurred as a direct result of an act of armed conflict in the course of war, invasion or insurrection.
An operator is not liable for injury or damage suffered by any person if the nuclear incident resulting in the injury or damage occurred wholly or partly as a result of an unlawful act or omission of that person done or omitted to be done with intent to cause injury or damage.

Where nuclear damage engages the liability of more than one operator, the operators involved shall, in so far as the damage attributable to each operator is not reasonably separable, be jointly and severally liable.
The operator shall be required to maintain insurance or other financial security covering his liability for nuclear damage in such amount, of such type and in such terms as the Installation State shall specify.
Where a nuclear incident does not occur within the territory of any Contracting Party, or within an area notified pursuant to paragraph 1bis, or where the place of the nuclear incident cannot be determined with certainty, jurisdiction over such actions shall lie with the courts of the Installation State of the operator liable.

The NRC also said it is banning one of the company's former engineers from working in the nuclear industry for five years.
