Nutrinova declined to seek reopening of the record, preferring to stand on its objection to the admission of the late-provided evidence.
Nutrinova argued to the court that its testing was not conclusive regarding whether the '629 process was used because it was possible, although there was no evidence offered to support the proposition, that the tested batches might have been subjected to post-processing to change the residual by-products in them.
