  James Edward Oglethorpe (1696-1785)
Oglethorpe spent most of the next decade in Georgia, where he directed the economic and political development of the new colony, defended it militarily, and continued to generate support and recruit settlers in England and other parts of Europe.
Oglethorpe was born on December 22, 1696, in London, England; he was the tenth and last child of Eleanor and Theophilus Oglethorpe.
Oglethorpe believed in the cause of Georgia—and as long as he had anything that he could mortgage to raise money for the colony, he was not going to give up.

Oglethorpe also was given the title of "General and Commander in Chief of all and singular his Majesty's provinces of Carolina and Georgia." This has led to confusion as to whether Oglethorpe was now a colonel or a general.

And by the time the adult Oglethorpe finally arrived to establish the new city of Savannah in 1733, the coastal borderlands between English Carolina and Spanish Florida had been largely uninhabited for almost half a century, except for the short-lived Fort King George (1721-1727) at the mouth of the Altamaha River.
As described by Oglethorpe himself upon his arrival, "A little Indian Nation, the only one within fifty miles, is not only at amity but desire to be subject of the Trustees, to have land given them and to breed their children at our schools.
Although this last fort was quickly abandoned at Spanish insistence, Oglethorpe's bold move to fortify his southern frontier effectively assured the ultimate survival of the new English colony, even though it pushed well beyond its chartered boundaries and into previously-undisputed Spanish lands.

 Oglethorpe Power v. FERC
First, the petitioner maintains that Georgia Power violated the filed-rate doctrine when it charged Oglethorpe for the capacity it had re-allocated from Gulf States to the RCL; the gravamen of this claim is that the reallocation contravened the terms of the PR Tariff and the 1982 agreement between Georgia Power and its partial-requirements customers.
Oglethorpe argues that none of the FERC's points provides a reasoned basis for denying Oglethorpe's claim to a share of the settlement.
As should be apparent, this purportedly alternative reason for rejecting Oglethorpe's claim to a share of the settlement proceeds likewise depends upon treating the entire settlement as compensation for damages that Georgia Power suffered before it re-allocated capacity from Gulf States to its territorial customers.
