 Justice Oliver Wendell Holmes
The common law was never thought to be coincident with the natural law, but the English jurists tended to assume that it had been informed by the natural law.
When the law seeks to determine the "intent" of someone who committed an act for which he is on trial, it is not seeking to determine whether he meant to do good or harm.
In the area of contract law, for instance, behaviorist jurisprudence meant that you did not have to guess whether there had been a "meeting of minds" between the parties to a contract: all you needed to do was determine what they said they had agreed to.

Holmes, Oliver Wendell - HighBeam Encyclopedia   (Site not responding. Last check: 2007-10-31)
He served (1861-64) with distinction in the Civil War, took a law degree at Harvard (1866), and began practice in Boston in 1867.
He maintained that the law could be understood only as a response to the needs of the society it regulated, and that it was useless to consider it merely a body of rules developed logically by legal theorists.
He became (1882) professor of law at Harvard and several months later was appointed to the Massachusetts supreme judicial court.

Oliver Wendell Holmes, Jr. | American Jurist
In 1882 Holmes became professor of law at Harvard, and was appointed to the Massachusetts Supreme Court in 1899.
A cornerstone of Holmes's judicial philosophy was his opinion that, "The life of the law has not been logic, but experience." He insisted that the court look at the facts in a changing society, instead of clinging to worn-out slogans and formulas.
He exercised a deep influence on the law through his support of the doctrine of "judicial restraint" which urged judges to avoid letting their personal opinions affect their decisions.

It being the case that law and economics is a success story, what are the reasons to call upon organization?
First, the orthodox theory of the firm-as-production function is self-limiting and needs, for some purposes, to be joined with the theory of the firm-as-governance structure.
And third, the traditional approach to teaching contract in the law school is reshaped if attention is shifted away from adjudication to focus predominantly on governance - as it should be.
