The Oneida Tribe are members of the League of the Iroquois, a confederacy of the Seneca, Cayuga, Onondaga, Oneida, and Mohawk based on mutual non-aggression.
Oneida settlers in Wisconsin were divided into two groups-Methodists and Anglicans-and they settled in a number of smaller communities on their new lands.
Whereas Oneida society had been strongly clan-oriented, life in Wisconsin was more focussed on the nuclear family of a married couple and their children, with other kin bonds extending out through the neighborhood.

Oneida Leader Testifies Before Assembly Hearing
The Wisconsin Oneidas have similar and difficult legal hurdles to overcome to argue that it is entitled to govern Indian land in two states.
Further, the Wisconsin Oneidas signed a separate federal treaty in 1838, the Treaty of Washington, which established a 65,000 acre reservation in Wisconsin and was approved without any participation by the Oneida Nation of New York.
If the Wisconsin Oneidas have any rights at all with respect to damages in the land claim litigation, at most it would be for rental damages prior to 1838, when the Wisconsin Oneidas signed the Treaty of Washington and accepted a reservation in Wisconsin.

There are at least two parts to the Wisconsin Oneida's claim; first to reclaim former homeland, and second, to establish a casino as a means to reach a settlement claim against the State of New York.
The Wisconsin Oneidas hope to be one of the three and revenue from that casino will repay them for the homeland lost to the state, Hughes said.

Oneida Indian Nation, 470 U.S. We were quite surprised to learn last fall that the Governor of New York was attempting to terminate outstanding New York land claim cases, without the involvement or approval of the Oneida Nation, and, remarkably, without paying any compensation to the Oneida Nation.
As a co-plaintiff with the Oneida Nation, the Wisconsin Oneidas have never had to establish their own land claim rights because they were in the case with the Nation as the lead plaintiff.
Many of the original members of the Wisconsin Oneida tribe were parties to the illegal transactions at issue in the land claims case before moving to Wisconsin and signing federal treaties to become a separately recognized Indian tribe.

The Oneida Daily Dispatch - Pataki: Deal would end land claim
Under the agreement, the Wisconsin Oneidas and the Stockbridge-Munsee tribes would assume all liability for the extinguishment of the Oneida Indian land claim, meaning, if the New York Oneidas feel they are entitled to monetary damages, they would have to take it up with those two tribes.
For the New York Oneidas, they would be able to maintain all their current property, as long as they establish a local service and impact agreement with Oneida and Madison counties for services such as fire and police.
The Wisconsin Oneidas sold out and relocated on their own accord about 200 years ago, but now that Pataki is dangling a casino in front of them, they want it.
