Briggs then acquired Lockwood Outboard Motor Company and negotiated a deal with Ole Evinrude which led to a deal which included Elto, Evinrude and Lockwood, which were collectively called the Outboard Motors Corporation (OMC).
OMC was deeply affected by the great depression as well as the loss of Bess Evinrude in 1933, and Ole Evinrude in 1934.
Their son Ralph, was asked to serve as OMC's president and they continued to introduce more new improvements and models.

OMC responds that section 4306 and the Coast Guard's regulatory decisions both expressly and impliedly preempt Lady's common-law tort claims, because subjecting OMC to a damage award would result in varying state requirements for recreational vessels, in direct contravention to Congress's intent to establish uniform requirements for recreational vessels.
OMC maintains that the Coast Guard's decision not to require propeller guards amounts to a determination that such a requirement is not appropriate, thus leaving manufacturers with the flexibility to choose an appropriate response to the safety issues presented by boat propellers.
OMC contends that to allow common-law claims to impose a rule requiring propeller guards would eviscerate the Coast Guard's decision that such a requirement should not be imposed and destroy the flexible approach adopted by the Coast Guard.

CPSC charged that OMC was aware the Lawn-Boy "L" series, "M" series, and Model 8157 mowers produced between 1987 and 1989 developed leaky gas tanks, but that OMC failed to report this to CPSC in violation of section 15(b) of the Consumer Product Safety Act.
In agreeing to settle this matter, OMC denied that the information relating to the lawn mowers was reportable under the Consumer Product Safety Act and that it violated the act in any way.
