Palazzolo filed an inverse condemnation action asserting that the denial of his permit applications amounted to a taking of his property without compensation in violation of the Fifth and Fourteenth Amendments.
Palazzolo argued for compensation because the cost for preserving wetlands should be borne by taxpayers and not by him as an individual property owner.

Palazzolo’s assertion fell under the Fifth Amendment of the United States Constitution, which states “…nor shall private property be taken for a public purpose without payment of just compensation.” Palazzolo argued that he was entitled to compensation for the alleged taking of property (the majority of which is salt marsh) adjacent to Winnapaug Pond.
Palazzolo had planned to develop the marsh into a 74-lot subdivision, but according to the court and CRMC, a proper application for the work was never filed.
Palazzolo had made a number of claims regarding the survey of the property, questioned which year’s mean high water mark should be used, and claimed that because the pond is subject to periodic closing of its breachway, that it is not a true tidal pond, and therefore is not subject to the Public Trust Doctrine.
