Palimony - Wikipedia, the free encyclopedia
Palimony is a slang term coined by attorney Marvin Mitchelson in 1977 when his client Michelle Marvin (the former Michelle Triola) filed an unsuccessful suit against actor Lee Marvin.
Despite the quasi-divorce proceeding suggested by the word, "palimony" is not a legal term and has never been used by the California Supreme Court.
Non-marital relationship contracts (or "palimony agreements," to use the slang) are not limited to two people, and because they are non-marital any party to a non-marital relationship contract can also be party to a marriage.

LSNJ LAW - Palimony—Support for Unmarried Partners Who Live Together   (Site not responding. Last check: 2007-10-21)
Palimony is the term that is used to describe the support that an unmarried person may request from his or her partner when the relationship between them comes to an end.
The sum of the support awarded is normally the amount determined to be necessary to support the plaintiff for the rest of her life, beginning from the time of the breakup of the relationship for as long as she might be expected to live.
This is because a palimony lawsuit arises out of a “family-type” relationship, and it is considered best to have this type of a case decided by a judge with expertise in family law.

Written palimony contracts are rare, but the courts have found "implied" contracts, when a woman has given up her career, managed the household or assisted in the man's business for a lengthy period of time.
The line between a mutual "affair" and a relationship warranting palimony is a difficult one which must be decided on a case by case basis.
Palimony suits may be avoided by contracts written prior to or during the relationship.

Palimony cases have been described as matters involving relationships "akin to a marriage" or a "marital-type relationship." When the law provides that marriage is defined as a relationship between one man and one woman, the question arises whether the law in palimony cases can be extended to same sex cohabitants.
It is easy to see how this standard may diminish the entitlement of a cohabitant in the case of a palimony promisor with limited means-- or where the palimony promisor may have obligations to a spouse entitled to alimony and unemancipated children entitled to child support.
Palimony litigants are not entitled to pendente lite relief unless they establish "the need is urgent and the probability of success high" with reference to their claims.

Although Zaremba had raised claims based on an oral or implied partnership agreement, the court noted that since he originally filed in a family court that he "considered the suit a 'family' matter." Palimony is a judicial term that recognizes modern practices of cohabitation and attempts to deal with parties equitably.
It suffices here simply to point out that cohabitation without marriage or prenuptial agreements incurs an opportunity cost that can be measured by the amount that the surviving partner could have received if she or he were married to the deceased partner or made a prenuptial agreement with the deceased partner.

Palimony sounds like "alimony," but conceptually palimony suits usually are closer to property division claims than to claims for maintenance and support (alimony).
It has been argued that by granting palimony claims, dividing property of unmarried cohabitants, and treating them economically as if they were a marriage unit, the law weakens the economic incentive to marry, and create an economic incentive for a competing relationship that undermines the marriage-based family.
These concerns are offset to some extent by concerns that failure to allow recovery of "palimony" will result in unjust enrichment to the economically well-off nonmarital partner (usually male) and provide him with an economic incentive not to marry, if the unmarried cohabitant is not allowed contract recovery.

The judgment of the appellate court is reversed and the judgment of the circuit court of Champaign County is affirmed.
The traditional rule prohibiting an action to obtain or recover palimony stems from three public policy concerns: (1) preserving morality,(2) preserving marriage and family institution, and (3) the principle of autonomy, privacy, or judicial prudence that discourages courts from attempting to enforce hard-to-prove agreements (he-said-she-said disputes), especially relating to intimate human relations.

The legal concept of "palimony", not gay marriage, is one of the contributing factors to the disintegration of "the sanctity of marriage".
Michelle Triola (the benefactor of the first palimony case against actor Lee Marvin) once said "If a man wants to leave a toothbrush at my house, he can damn well marry me." Well, if a woman wants financial support from a man, she can damn well end the relationship if he won't marry.

LOS ANGELES — Divorce lawyer Marvin M. Mitchelson, who pioneered the legal revolution known as "palimony" and represented scores of Hollywood clients in high-profile, big-money marital disputes, has died.
The Marvin vs. Marvin palimony case made him a household name in the 1970s.
The award was later overturned, but the precedent-setting concept of palimony upheld by the California Supreme Court as part of the case came to signify a new social order for unmarried, cohabitating partners.
