Papinian - Wikipedia, the free encyclopedia
Papinian (Aemilius Papinianus) (died AD 212), was a Roman jurist, magister libellorum and afterwards praetorian prefect under Septimius Severus.
Papinian tried to keep peace between the brothers, but this only excited the hatred of Caracalla, and who ordered his murder in the general slaughter of Geta's friends which followed the fratricide of AD 212.
He was perhaps a Syrian by birth, for he is said to have been a kinsman of Severus's second wife, Julia Domna; that he studied law with Severus under Scaevola is asserted in an interpolated passage in the Historia Augusta.

Papinian tried to keep peace between the brothers, but with no better result than to excite the hatred of Caracalla, to which he fell a victim in the general slaughter of Getas friends which followed the fratricide of AD 212.
The details are variously related, and have undergone legendary embellishment, but the murder of Papinian, which took place under Caracallas own eyes, was one of the most disgraceful crimes of that tyrant.

Papinian was a victim of this fratricide in AD 212, being murdered, tradition has it, for refusing to compose for Caracalla a legal justification for his tyranny.
Papinian was most known for his elegant and precise interpretation of existing legal ideas, rather than for any original legal thought.

There is also the story that Papinian refused to compose a speech in which, to improve the murderer's case, the brother was to be attacked; and that in his refusal he had declared that to accuse an innocent man who had been murdered was a second act of murder.
It is further related that Papinian, when, seized by the soldiers, he was being hauled to the Palace to be put to death, foretold the future, saying that whoever should succeed to his position would be an utter fool did he not take vengeance for this brutal attack on the prefecture.
