On April 22, 1992, appellants filed a complaint in the district court alleging that Thompson was negligent in failing to either corral the horse or warn oncoming motorists of the stray animal and that his negligence was the proximate cause of appellants' injuries.
Wyoming Statutes s 1-39-112 (Rev.1988) only applies if peace officers are "acting within the scope of their duties." Thompson was off-duty and was not in the scope of any duties for Park County.

 Park County joins state wolf lawsuit
CODY, Wyo. (AP) -- Park County will join the state's court fight demanding the federal government accept Wyoming's plan to manage wolves once they are delisted.
County attorney Bryan Skoric said the county was notified July 26 it could intervene in the lawsuit.
"As a plaintiff in the lawsuit, Park County can now align itself with the state to argue that the federal government has failed to delist and properly manage the gray wolf population in Wyoming," he said.
