At least three other attempts have been made to define the Parliament's privileges.[46] In 1985, a Joint Select Committee on Parliamentary Privileges recommended that legislation be passed providing that the Parliament has the privileges of the House of Commons at 1856[47] but no such legislation was introduced.
A challenge to the constitutionality of these provisions in the Court of Appeal of New South Wales was unsuccessful and, on a request for special leave to appeal that decision in the High Court, the court found that the Parliament's plenary powers include the power to affect its privileges.
