Upon expiry of the 60 years, the NCR landowners 'may apply' to the 'Land and Survey Department' for the issue of a grant over one's land and the Superintendent of Land and Survey 'may issue' the grant to the landowner with terms and conditions as he deems fit to impose.
The difference between NCR land and lease land is that the NCR land is perpetual subject to observance of customary laws and practices, but a grant of land by the Sarawak government is a renewable lease for 60 years.
The government can do that by invoking other provisions in the Sarawak Land Code because NCR land is defined differently in the statute and as with other categories of land, the Minister is empowered to declare any piece of land as developed area hence taking over such land for development purposes.
