TCS Daily - Choice and Its Enemies
But that inability of libertarian paternalism to pass the laugh or sanity test has apparently not dampened the enthusiasm of the paternalists themselves in pushing their bizarre theory in respectable academic and political circles.
Libertarian paternalism, according to Professor Thaler, is based on the belief that [p]eople have to know what their preferences are and they have to know how the options they have map onto their preferences.
Two advocates of the effort to limit choice -- Richard Thaler, an economist at the University of Chicago and Cass Sunstein, who teaches at the University Of Chicago Law School -- even have a name for this nascent busybody program; libertarian paternalism.

 Peter Suber, "Paternalism"
In a welfare state which shifts costs to compensate those who harm themselves, virtually all self-harm will be other-harm too; hence virtually every corner of life could be regulated by law without violating the harm principle, and virtually all paternalism would be justified.
This fact, however, does not make arguments for and against paternalism vacuous.
There are many other ways to do what the paternalist does but without paternalism: notably, to widen the definition of harm, and to narrow that of valid consent.

Paternalism may be justified or unjustified, but the paternalistic treatment of adults always requires justification because of the infringement of the person's right that it entails.
Paternalism in the treatment of clients most commonly arises in professional contexts where the professional has a face-to-face relationship with those whose well-being they seek to ensure and in professions where practitioners are in positions of greater power than their clients.
Paternalism may be roughly defined (following Gert and Culver) as violating a moral rule of conduct toward someone or limiting that person's self-determination (and hence often infringing that person's rights) for what is perceived as being that person's own benefit.

Senator Peffer, Mission of the Populist Party, 1893
All there is in the charge of paternalism lies in the fact that Populists believe that, as to these particular matters, the people would be served, more equitably and at greatly reduced expense, by public agents working on fixed salaries, than by private persons who use their business for private ends.
It is charged against Populists that they favor paternalism in government.

Re: Criticism: Donald Akers Summarizes Critics' Ideas on "Rose"
Emily is lonely enough to date a Yankee--and perhaps her choice of suitor is a way of rebelling against her father [and the mores of the town that he embodied, including paternalism].
In clinging to her dead father, she also clings to the paternalism of the antebellum South, which made her a kind of "idol." Poisoning Homer is a desperate attempt to stop time, [at least within the confines of her own house, her father's house].
But Emily is a strange character well before the end of the story, as her treatment of the aldermen suggests.

In other words, if the argument in the Laws suggests paternalism, it is not the kind of paternalism which we ought to reject.
In the Menexenus Plato argues that laws are just in so far as they promote virtue in the city, just as parents are good parents, from the point of view of virtue ethics, if they encourage virtue in their children.
However, the Menexenus and the Crito with their explicitly and extensively developed use of the parent analogy remain the most straightforward Platonic sources for beginning our investigation into the possibility of a virtue ethical account of just laws.

 History On-Line
Just as Marx imagined a revolutionary communist Narodism as a third way beyond Slavophile paternalism and capitalist liberalism, so Winstanley imagined communist Digging as a third way beyond feudal paternalism and capitalist improvement.
To those who fear that a comparison of Winstanley and Marx necessarily leads to reductive secularization, I argue that there are strong affinities among Winstanley's agrarian communism, Marx's vernacular communism, and contemporary liberation theology.
As opposed to traditionalist opponents of agrarian capitalism, Winstanley constructed a materialist theory of history as class struggle, a dialectical psychology, a dialectical theory of the transition from oppressive enclosures to utopia, and a communist theory of agrarian improvement that cancelled and preserved the capitalist science of the Hartlibian Enlightenment.

Indian policy based on Paternalism may have started as simply guardianship of the Cherokee Nation and its lands in an effort to bring them around to a Christian way of life, but in the end Paternalism was the platform that the Jackson administration used to take their land and ignore their rights.
Marshall was faced with the question; "Do the Cherokee constitute a foreign state in the sense of the Constitution?" Marshall found the Indians to be in, "A state of pupilage; their relation to United States resembles that of a ward to his guardian.

 People Will Talk
The medical paternalism (evident in the variety of ways Praetorius deceives patients) reveals a type of medical practice that most students will find morally troublesome; these acts of paternalism are presented in the film as simply an aspect of Praetorius's humanity.
Praetorius also transgresses many standard moral beliefs concerning the dating of patients and physicians as well as that of students and professors, but it is difficult to determine how the filmmakers wish their audience to judge these events.
There are many features that make People Will Talk worth discussing with medical students.

The distinction between moralistic and non-moralistic paternalism is possible on by distinguishing between harms that are scientifically demonstrable to everyone, and those that depend on adopting some controversial philosophical or theological theory.
Libertarianism would exclude all forms of paternalism, whether moralistic or not.
Mill's harm principle applies, not only to the power of the state, but also to the actions of civil society.

The Economic and Political Inequity of "Sin Taxes" on Tobacco and Alcohol Products
One argument for paternalism, as described by Ronald Dworkin, contends that "in a genuine political community each citizen has a responsibility for the well-being of other members and should therefore use his political power to reform those whose defective practices will ruin their lives." [FN58] Ruination of one's life, however, is a subjective concept.
Part III examines the ethical and political problems of government paternalism, of which sin taxes are an example, and argues that paternalistic taxation unjustifiably restricts the individual liberties which are essential to mature human development and to the legitimacy of the democratic process.
Before discussing the particular shortcomings of sin taxes, it will be helpful to analyze some general justifications for paternalistic intervention in order to discern whether a type of regulation with a more equitable incidence (such as a flat-out prohibition) would be defensible.

While Satel does not explicitly defend paternalism in the name of public health, she has little patience for critics of paternalism in the name of psychiatry.
Satel, a fellow of the American Enterprise Institute and a lecturer at the Yale University School of Medicine, is most persuasive as the voice of calm reason, dissecting the abuse of science for ideological purposes.
Satel does not reject out of hand the possibility that there might be something to learn from alternative medicine, but she insists that its remedies be held to rigorous scientific standards.
