Clement is a native of Cedarburg, Wisconsin, and graduated from Cedarburg High School (public) in 1984.
Clement clerked for Judge Laurence H. Silberman of the U.S. Court of Appeals for the D.C. Circuit, and for Associate Justice Antonin Scalia of the U.S. Supreme Court.
Clement also served from 1998 to 2004 as an Adjunct Professor at the Georgetown University Law Center, where he taught a seminar on the separation of powers.

Justice John Paul Stevens jumps in: "Does that mean you can torture an agent if you are dissatisfied with their work?" Clement says that claims like that don't turn on the secret nature of spy contracts.
Clement claims that an explicit rule requiring the dismissal of all spy cases under Totten "sends out a clear message" to spies: "There's no point in bothering to file suits, they will be dismissed." He says that rather proudly—as though the legal process was a newish experiment that has largely failed.
