Montanez alleges that his rights were violated and that he was falsely arrested from an incident in 2001.
Montanez states that he "intervened in a fight between his brother, Pedro Montanez and Ruben Hernandez to break up the fight." He was subsequently charged with felony counts of aggravated assault and aiding and abetting aggravated assault.
Montanez in his suit claims that Lewis and the unnamed officers should have known there was not enough evidence for an arrest, thus alleging he was falsely arrested.
