ABA officials lauded Penguin for voluntarily allowing ABA to conduct an investigation of the "cash discounts" related to payment of receivables that were given to some Penguin customers, and for agreeing to the comprehensive settlement reached September 29.

Last week, in the days after the terms of ABA's $25 million settlement with Penguin over improper discounting practices became public, word spread throughout the book industry that ABA's payment from Penguin Putnam Inc. was by far the largest in the history of U.S. antitrust discrimination law.
The payment, half of which is earmarked for distribution to ABA member bookstores, is part of an agreement ending a dispute related to favorable terms of payment that only some Penguin customers received (for further details, see the October 4 special edition of BTW that mailed last week).
ABA counsel Jerry Jacobs of the Washington, D.C., law firm Jenner and Block said it would be difficult to overstate the significance of ABA's settlement in terms of antitrust discrimination law, which the government has been slow to enforce.
