  Edwards v. Canada (Attorney General) - Wikipedia, the free encyclopedia
Canada (Attorney General) [1930] A.C. 124 – also known as the Persons' Case – is a famous Canadian/British constitutional case where it was first decided that women were eligible to sit on the Senate.
The case, put forward by the Famous Five, went all the way to the Privy Council and was a landmark case in many respects.

The legal recognition of women as persons with rights was not obtained at the same time as the suffragette movement.
Indeed, women were not legally recognized as "persons." Furthermore, when women married, they lost all of their rights.
In its ruling, the Canadian Court stipulated that the term "person" did not apply to women, alleging that when the British North America Act was signed, jurisprudence did not consider women as "qualified persons." If the Constitution had included women in this definition, it would have been duly noted.

In 1928, the SUPREME COURT OF CANADA unanimously decided women were not "persons" who could hold public office as Canadian senators.
The terms of the CONSTITUTION ACT, 1867, and the historical incapacity of women to hold office under common law barred the suit of Henrietta Muir EDWARDS and her companion Alberta suffragettes.
In 1929 the British Privy Council reversed the decision and called the exclusion of women from public office "a relic of days more barbarous than ours." The Governor General's Persons Award, for work on behalf of Canadian women, is named for the case.

The BNA Act used the word persons when referring to more than one person, and the word he when referring to a single individual, which led some to infer that as a matter of law only men were persons.
One might think that the view that women are not persons was already an anachronism in 1927, as (white) women had already obtained the right to vote in 1918, due in considerable part to the efforts of Nellie McClung, but the Supreme Court ruled that indeed women were not persons.

On January 4, 2002 Canadian homemaker and teacher Beverley Smith wrote to the Attorney General of Canada, Anne McLellan, requesting that she refer to the Supreme Court of Canada for hearing six questions of law concerning the value of caregiving in Canada.
