On August 6, long-term immigration detainee Stephen Khan was released from detention at the Perth Immigration Detention Centre on the order of Federal Court Justice Malcolm Lee.
The legal argument in court centred on whether Khan has a case to argue that his detention is unlawful.
This stems from a precedent set earlier last year, in the Al Masri case, in which the Federal Court ruled that immigration detention is only allowed for the purposes of administration.

This bill is designed to prevent the release of a Œprisoner¹‹and I use that word advisedly‹held in an Australian immigration detention centre, pending a court¹s final determination of the substantive matter as to the lawfulness of a person¹s detention or whether a person is an unlawful noncitizen.
It makes it more difficult for Australian courts to intervene to release people from our immigration detention centres, especially those who have no likelihood of finding a visa to another country or who have real fears for their personal safety, and the safety of their families, should they return home.
In a debate dealing with mandatory detention, so-called queue jumpers and people bringing about their own detention by coming to Australia without appropriate papers, it might be worth while to consider the plight of one real, flesh and blood victim of Australia¹s immigration detention system.

 Immigration detention centre review
Those detained in Australia's immigration centres are considered by the Association to be disadvantaged in their access to library and information resources and services compared with the general community, which has ready access to the comprehensive Australian public library network for educational, informational, technological and recreational purposes.
However the linguistically and culturally diverse and changing populations of the centres require flexible and cost-effective responses about which public libraries and their central agencies are well placed to advise and assist.
With 61 detainees from fiftenn nations, this centre is small with a diverse and unstable population, although some detainees at the time of the visit had been there for up to two years.
