However, the appellant does not, and could not, contend that Dr Bennett's source code expression of the meaning of commands or of the grammatical and syntactical rules in PFXplus is a reproduction of the source code expression of those meanings or rules in the Dataflex language.

The error text tables in PFXplus were substantially similar to those in Dataflex and the compression table in the Dataflex run-time program was reproduced in identical form in PFXplus.
Each of the words of the Dataflex language and the assignment of functions to keys was held to be a "computer program" in the terms of the statutory definition since ea ch was an expression of a set of instructions intended to cause a computer to perform a particular function.
The table in PFXplus was identical to the Dataflex table and was derived from it by Dr Bennett, not by direct copying but by a fl box reverse engineering process which resulted in a rep roduction of the Dataflex table.

PFXplus was created by a process of reverse engineering and study of the operation and documentation of Dataflex with the intention of achieving complete compatibility.
Data Access commenced proceedings in Australia against Powerflex and its proprietors, including the author of PFXplus, for injunctive relief seeking to restrain the reproduction and distribution of PFXplus and also damages on the grounds that the copyright of Data Access had been infringed in breach of section 10 of the Australian Copyright Act 1968.
The original judgment in the case was delivered by Jenkinson J in the Federal Court of Australia in February, 1996 and PFXplus was found to infringe the copyright of Data Access.

IMHO it's the *only* good thing about make.
PFXplus (our language product) has a large amount of declarative capability, as well as 3GL, 4GL and OOPS.
